Applicable legal framework
The tourist use housing activity in Galicia is mainly regulated by the Decreto 12/2017, of January 26, and by the administrative processing of the Xunta through the procedimiento TU986D. This procedure requires submitting a responsible declaration of the start of activity, signed by the owner or their representative, to the corresponding provincial area of the Tourism Agency of Galicia.
In parallel, the Real Decreto 933/2021 imposes on the obligated parties a documentary and informational registry of the guests, with telematic communications and data retention for three years. The regulation applies to lodging activities, including tourist accommodations operated professionally or not, and establishes serious and minor infringements for failure to comply with the registries or communication deadlines.
Regional procedure to register a tourist accommodation in Galicia
The registration of the tourist-use dwelling is formalized through the responsible declaration of commencement of activity, using the standardized model provided in annex V. The documentation indicated on the Xunta’s electronic headquarters includes proof of payment of fees and, when there is more than one natural or legal person marketing, annex VIII.
The submission is preferably made electronically through the Xunta de Galicia headquarters, although the procedure remains open throughout the year. Once the declaration has been submitted, the resolution period is three months and administrative silence is considered positive.
Essential requirements
To start the activity, the property must meet the requirements established by the Galician tourism regulations and maintain those conditions throughout the operation. The responsible declaration implies that the owner affirms having the required documentation and material compliance, without prejudice to subsequent inspections by the Administration.
Among the usual data and elements of the file are the identification of the owner, the location of the property, and the declaration that the requirements of the regional regulations are respected. Once the accommodation has been registered, the establishment must register on the state platform SES.HOSPEDAJES to comply with Royal Decree 933/2021. The system requires the prior communication of the establishment’s data before starting the activity and the submission of guest data within the legally established deadlines.
The state regulation establishes that communications relating to the start of the activity must be made within ten days from the previous administrative procedures and, in any case, before the actual exercise of the activity. Additionally, the data on reservations, bookings, cancellations, and stays must be sent immediately and, in any case, within a maximum of 24 hours, by telematic means.
Consequences of non-compliance
The lack of documentary registration or the omission of mandatory communications may be sanctioned as a serious infraction. Irregularities in the completion of the register or the late submission of the required information also constitute minor infractions.
Therefore, from a legal and operational perspective, the launch of a tourist accommodation in Galicia does not end with the autonomous responsible declaration. The activity is only properly regulated when both the autonomous tourist registration or authorization and the state traveler control regime are simultaneously fulfilled.
